Des Moines, March 28, 2012 – On Thursday, April 5, 2012, at 2:00 p.m. Appellate Court Judge Thomas N. Bower will take the oath of office in a public ceremony in the supreme court courtroom in the Judicial Branch Building. Judge Bower, 51, fills the vacancy on the Iowa Court of Appeals that occurred when Chief Judge Rosemary Sackett retired.

Judge Bower, Cedar Falls, was appointed to the district associate court bench in 1993 and the district court bench in 1995. He was appointed Chief Judge of the First District in 2010. He received his bachelor's degree from Illinois State University in 1984 and his law degree from Drake University in 1987. Before becoming a judge, he served as an Assistant City Attorney for the City of Ames and as an Assistant Black Hawk County Attorney. Judge Bower helped to establish the Black Hawk County Adult Drug Court program in 2006 and a mental health court program in 2009. Judge Bower is a member of the Iowa State Bar Association, Black Hawk County Bar, and the Iowa Judges Association.

Judge Bower is married and has two sons.

Des Moines, March 14, 2012 – Today, the task force established to propose reforms to Iowa's civil justice system released its final report, which is posted on the Iowa Judicial Branch website. The Iowa Civil Justice Reform Task Force studied and considered court innovations to make Iowa's civil justice system faster, less complicated, more affordable, and better equipped to handle the demands of Iowa litigants and users of the civil justice system.

 

In December 2009 the Iowa Supreme Court appointed a 14-member steering committee to oversee the work of the task force. In August 2010, seventy-one additional justice system stakeholders from across Iowa joined the task force. The membership represented business, labor, medicine, industry, consumer groups, the bench and the bar. For more than a year, the task force studied innovative litigation procedures and programs that work well in other parts of the country.

 

"A dedicated group of 84 volunteers representing all shareholders in our court system engaged in a comprehensive assessment of the Iowa civil justice system, including a broad survey of all Iowa lawyers and judges, to identify new court processes and improvements in current practices that will promote efficiencies and reduce the often substantial costs of non-domestic civil cases," said Iowa Supreme Court Justice Daryl Hecht, the chair of the task force.

 

The task force has submitted its report to the Iowa Supreme Court, which will review the recommendations and findings contained in the report and consider implementation of cost-effective and promising reforms that will match the needs of Iowans.

STATE OF IOWA, Plaintiff, vs. IOWA DISTRICT COURT FOR BLACK HAWK COUNTY

Des Moines, March 5, 2012 ? On Thursday, March 8, members of the Iowa Supreme Court will visit seven Council Bluffs area high schools and also classes at Iowa Western Community College to talk with students about the role of the courts. In Council Bluffs, the justices will visit with students at Jefferson, Lincoln, and St. Albert High Schools and the Iowa School for the Deaf. Justices will also visit Glenwood High School and Treynor High School.

 

In addition to the school visits, the court will hold a special session in Council Bluffs on the evening of Wednesday, March 7. The court will hear oral arguments in two cases at the Iowa Western Community College Arts Center. This session begins at 7 p.m. As always, oral arguments are open to the public. A public reception with the justices, sponsored by the Pottawattamie County Bar Association, will follow the oral arguments.

The court will hear attorneys argue in two cases:

Mall Real Estate v. City of Hamburg

Plaintiff, Mall Real Estate, asked the Iowa District Court for Fremont County to declare that the City of Hamburg's "sexually-oriented business" ordinance either did not apply to plaintiff's business or that it was an unconstitutional regulation and could not be enforced against plaintiff's business. The district court found the ordinance did apply to plaintiff's business and that it was a constitutional regulation. Plaintiff appeals the district court determination.

 

The lawyers for Mall Real Estate are: Brian B. Vakulskas and Daniel P. Vakulskas, Sioux City, and W. Andrew McCullough, Utah. The lawyer for the City of Hamburg is Raymond R. Aranza, Cedar Rapids.

 

American Civil Liberties Union v. Atlantic School District

Petitioner, the American Civil Liberties Union (ACLU), seeks additional information regarding discipline imposed on two school district employees after a "locker room strip search" of five female students. The Atlantic School District claims Iowa law does not require public disclosure of such job performance documents. The ACLU argues the Iowa Court of Appeals incorrectly interpreted a recent legislative amendment that should have permitted disclosure of the disciplinary action.

Des Moines, February 28, 2012?On April 10, the Iowa Supreme Court will hear oral arguments in Bettendorf. The court proceedings will take place at the Pleasant Valley High School auditorium, located at 604 Belmont Road. The session will begin at 7 p.m.

The court will hear attorneys argue in two cases yet to be announced.

The supreme court hears cases on appeal, which involves the review of a decision of another court. During oral arguments, the court does not conduct trials, hear witnesses, or admit new evidence. The court determines whether legal errors were committed in the rendering of the lower court's judgment or order. The supreme court can affirm?uphold the decision or order of the lower court, reverse?set aside the decision or order, or remand?send the case back to the lower court with instructions, including instructions to hold a new trial.

The Iowa Supreme Court is composed of seven justices, each appointed by the governor from a slate of three nominees selected by the state judicial nominating commission. Court members are: Chief Justice Mark Cady, and Associate Justices David Wiggins, Daryl Hecht, Brent Appel, Thomas Waterman, Edward Mansfield, and Bruce Zager.

Supreme Court to Stream Item Veto Case Live on the Internet

 

Des Moines, February 16, 2012 ?The February 21 special evening session of the Iowa Supreme Court oral arguments in the item veto case of Homan v. Branstad will be streamed live on the Internet beginning at 7:00 p.m. Oral arguments are always open to the public and the special session is scheduled for the evening primarily for the convenience of members of the public and state officials who would like to attend. The oral arguments will be heard in the Supreme Court Courtroom on the fourth floor of the Judicial Branch Building in Des Moines.
