Earlier this year, the General Assembly approved statutory changes that prohibit the possession, receipt, and shipment of firearms and ammunition by a person found by a court to be mentally ill. To comply with this legislation, the court amended two forms used for civil commitments pursuant to Chapter 229 of the Iowa Code.

Iowa Court Rules (November 10, 2011)

Amendment to chapter 11 of the Iowa Court Rules? Adoption of Standards of Conduct for Mediators Summary?At the recommendation of the Iowa State Bar Association, the American Academy of Alternate Dispute Resolution Attorneys, and others, the court replaces chapter 11 of the Iowa Court Rules, "Rules Governing Standards of Practice for Lawyer Mediators in Family Disputes," with new standards of conduct for mediators. The current standards have changed little since their adoption in 1987. The new standards mirror the 2005 Model Standards of Conduct for Mediators with one exception. The court added a provision concerning the scope of the rules. This provision provides that the "standards apply to mediators who are lawyers licensed to practice law in Iowa, mediators who participate in any mediation program approved by a court of this state, and mediators in any matter required to be mediated by an Iowa court order or rule." The standards for mediators in the prior version of chapter 11 applied to lawyer mediators in family disputes only. The new standards take effect January 1, 2012.

Iowa Court Rules (November 24, 2010)

Amendment to Rule 41.12 requires all lawyers newly admitted by examination to complete a basic skills course on Iowa law within one year after admission to the Iowa bar. The supreme court amends the rule to permit new lawyers to take the basic skills course during the time between completion of the bar examination and admission to practice.

Iowa Rules of Civil Procedure (August 3, 2010)

Amendments to Rules of Civil Procedure 1.1007 and 1.1008--Time to file certain post-ruling motions
These amendments increase the amount of time that a party has to file certain post-ruling motions. The court increased the time to file such motions from ten days after the filing of a verdict to fifteen days after the filing of a verdict. This additional time is intended to address case processing delays that cut into the time parties have to file such motions. These delays are the on-going consequence of the severe cuts in the judicial branch budget over the past decade.

Amendment to Rule of Criminal Procedure 2.19(4) Reporting Opening Statements and Closing Arguments?This amendment requires the reporting of opening statements and final arguments in a criminal trial. The former version of the rule required reporting of these remarks only upon request of a party. The purpose of this amendment is to ensure that a complete record of all aspects of a trial exists to enable a complete review of a case on appeal. Under the former rule, the absence of a record of opening statements and closing arguments frequently hampered appellate review, particularly with regard to questions of error preservation and prejudice.

Summary?Earlier this year, the court amended this rule to require the payment of a filing fee when filing a motion or petition for vacating or modifying a judgment. Later, the court was informed of confusion among clerks of court and attorneys about the application of this rule, particularly with respect to small claims cases. Clerks of court asked for guidance. To clarify the rule, the court adopted this amendment. The amendment clarifies that a petition of this nature when filed in small claims shall require payment of the fee for filing a small claims case set forth in section 631.6(1)(a). Currently, the filing fee for small claims cases is $85.

Des Moines, December 6, 2012? The Iowa Supreme Court has appointed District Judge Mary Ann Brown, Burlington, as Chief Judge of the Eighth Judicial District. Judge Brown succeeds Chief Judge James Q. Blomgren who will retire December 6, 2012.

"Judge Brown is an excellent judge with experience as an attorney and on the bench," Chief Justice Mark Cady said. "The supreme court is confident she has the skills needed to be a fine chief judge and a strong leader in the Eighth Judicial District."

Judge Brown was appointed district judge in September 2001. She received her bachelor's degree from Drake University in 1981 and her law degree from the Drake University School of Law in 1984. Judge Brown worked as a prosecutor for the Des Moines County Attorney's Office from 1985 to 1990. She was in private practice with Bauer, Schulte, Hahn, Swanson & Brown from 1990 to 2001. Judge Brown is a member of the Iowa Judicial Qualifications Commission, The Eighth Judicial District Department of Correctional Services Board of Directors, the Iowa Judges Association, the Iowa State Bar Association, the Des Moines County Bar Association, and served as past chair of the Iowa Board of Examiners of Shorthand Reporters. She is also a member of the Girl Scouts of Eastern Iowa/Western Illinois Board of Directors and, in 2000, she received a Bar Association Community Service award.

"I am honored and humbled to have been selected a Chief Judge for the Eighth Judicial District," Judge Brown said. "As Iowans we can all be proud of the outstanding court system in this state. It will be a privilege to have this opportunity to work with all the outstanding, hardworking judges and other court staff in this judicial district. Working together we will successfully meet the ever changing challenges to efficiently and effectively serve the legal needs of our citizens."

As chief judge, Judge Brown will supervise all judicial officers and court employees in the district, supervise the performance of administrative and judicial business in the district, set the times and places of holding court, designate presiding judges, and serve on the judicial council, which advises the supreme court on administrative matters affecting the trial courts. In addition, she will continue to preside over cases.

The Eighth Judicial District is located in southeast Iowa and comprises 14 counties: Appanoose, Davis, Des Moines, Henry, Jefferson, Keokuk, Lee (with two county seats?Fort Madison and Keokuk), Louisa, Mahaska, Monroe, Poweshiek, Van Buren, Wapello, and Washington. The district has 11 district judges, seven district associate judges, one associate juvenile judge, four senior judges, 13 part-time magistrates, and 156 employees, with an operating budget for the current fiscal year of approximately $14.2 million. A total of 73,056 cases were filed in the Eighth Judicial District last year.

SPRINGFIELD, IL (11/05/2012)(readMedia)-- Illinois Air National Guardsman Col. Rich Neely of Springfield was named the Illinois National Guard's Chief of the Joint Staff today by Maj. Gen. Dennis Celletti of Springfield, Acting Adjutant General at Camp Lincoln in Springfield.

Although an Airman, Neely has led the Illinois Army National Guard's Directorate of Information Management for the last two years as the Chief Information Officer.

"As an Airman who led an Army directorate, Col. Neely is perfect for this position," Celletti said. "His work as the lead planner during the NATO Summit this spring, as well as his past experience in communications, logistics, finance and domestic operations, has prepared him to take the Joint Staff to new heights."

This position oversees the Illinois National Guard's domestic operations as well as various programs such as family programs, counterdrug, International State Partnership Program, civil support and chemical, biological, radiological/nuclear and explosive (CBRNE) enhanced response force package (CERFP).

He will replace Illinois Army National Guardsman Col. Chris Lawson of Springfield who will deploy early next year to Afghanistan with Bilateral Embedded Staff Team 11 as the deputy task force commander for a Polish task force.

"Rich is a brilliant and talented senior officer who will excel as the Chief of the Joint Staff. He understands the environment and players in the joint community at the international, federal, state and local levels," Lawson said. "He knows how to cultivate unity of effort to achieve results for the Illinois Air and Army National Guard."

Neely started his military career as a U.S. Army Reservist in 1984. He transitioned to the Illinois Air National Guard in 1987, then commissioned as a second lieutenant in 1990. His most recent military assignment was commander of 183rd Air Component Operations Squadron (ACOS), 183rd Air Operations Group at the 183rd Fighter Wing in Springfield.

Other highlights of Neely's career include chief of logistics plans and programs, financial officer, wing executive officer, communications flight commander and Illinois Air National Guard Deputy United States Property and Fiscal officer. He has also deployed overseas twice in support of operations Iraqi Freedom and Enduring Freedom.

"Each one of my jobs has prepared me for this position," Neely said. "I am humbled to be selected for this position and look forward to continue to serve the citizens of Illinois in this new capacity. Col. Lawson is an incredible leader and strategic visionary who is regarded nationally as one of the best Chiefs of Staff within the National Guard. I am fortunate to follow such a great officer and Soldier."

DeMarcus Montrell McGee, age 33, committed his crimes on January 22, 1998 in Black Hawk County.  He is currently serving a sentence for first-degree robbery.

Andrew Lee Stephens, age 30, committed his crime on May 12, 2003 in Black Hawk County.  He is currently serving a sentence for first-degree robbery.

Evelyn Lou Tangie, age 67, committed her crime on July 27, 1996 in Wapello County.  She is currently serving a sentence for murder second-degree.

WASHINGTON - Oversight and Government Reform Committee Chairman Darrell Issa, R-Calif., and Senate Judiciary Committee Ranking Member Chuck Grassley, R-Iowa, today released the second installment of their final report on Operation Fast and Furious. This report chronicles the U.S. Department of Justice's management failures, specifically finding fault with five senior Justice Department officials for failing to identify red flags indicating reckless tactics.

 

"The report discloses widespread management failures within the hierarchy of the Justice Department," said Issa.  "The Justice Department has yet to evaluate these management issues and implement structural changes to prevent another disaster like Operation Fast and Furious from occurring. Furthermore, the Justice Department has taken limited action against these negligent managers."

 

"Officials in the Justice Department saw any number of warnings and some even had the gunwalking information right in front of them, yet nothing was done to stop it.  Countless people may be murdered with these weapons, yet the Attorney General appears to be letting his employees slide by with little to no accountability.  The Attorney General needs to make changes to ensure that department leadership provides oversight of the agencies they are tasked with supervising, instead of pointing fingers at somebody else," Grassley said.

 

Operation Fast and Furious contributed to the deaths of U.S. Border Patrol Agent Brian Terry and an unknown number of Mexican citizens.  It also created an ongoing public safety hazard on both sides of the border.  The failures happened because of conscious decisions to encourage gun dealers to sell to known traffickers and avoid interdicting those weapons or even questioning suspects, all in the hope that would lead law enforcement to cartel connections and a larger case.

Report highlights:

  • A detailed account of the interview with former ATF Acting Director Kenneth Melson.
  • The Obama Administration's new focus on trafficking and targeting of drug cartels, which led to the strategy behind Operation Fast and Furious.
  • Testimony from senior Justice Department officials about Operation Fast and Furious and the management problems it entailed. The report finds fault with five senior DOJ Officials for failing to supervise and for missing basic red flags.  Those officials are Assistant Attorney General Lanny Breuer, Acting Deputy Attorney General Gary Grindler, Deputy Assistant Attorney General Jason Weinstein and Associate Deputy Attorney General Ed Siskel. Attorney General Holder's Deputy Chief of Staff Robert "Monty" Wilkinson also bears some responsibility for the poor management that lead to Operation Fast and Furious.
  • Acting Deputy Attorney General Gary Grindler, Associate Deputy Attorney General Ed Siskel, and other officials from the Office of the Deputy Attorney General attended a detailed briefing on Operation Fast and Furious in March 2010.  Despite the evidence presented at the briefing of illegally-purchased firearms being recovered in Mexico and in the U.S., Grindler and Siskel failed to ask probing questions or take any significant follow-up action to monitor and supervise the conduct of the case.
  • ATF officials asked both the Justice Department's Criminal Division and ODAG for assistance in speeding up the indictments in Fast and Furious.  The Justice Department, however, took no action to intervene.  Instead, officials at Department headquarters only showed concern about preparing for the press impact of the indictments.
  • Deputy Chief of Staff to the Attorney General Monty Wilkinson discussed Attorney General Holder participating in the press conference announcing the take-down of Operation Fast and Furious prior to the death of Border Patrol Agent Brian Terry.
  • Both Monty Wilkinson and Gary Grindler were informed about the connection between Operation Fast and Furious and U.S. Border Patrol Agent Brian Terry's murder.  Grindler received detailed information about the connection.  He took no additional action, however, to properly supervise the operation.
  • No one at Justice Department headquarters have provided complete and accurate answers to the Terry family.  During their respective transcribed interviews, Monty Wilkinson stated 38 times that he "did not recall" or "did not know."  In a similar fashion, Gary Grindler did so 29 times, and Ed Siskel 21 times.  In two different transcribed interviews, Dennis Burke said he "did not recall" or "did not know" a combined total of 161 times.
  • Recommendations for future management of DOJ.

STATE OF IOWA vs. LORRAINE ANN MESSER

Washington, D.C. - Congressman Dave Loebsack today announced that law enforcement jurisdictions across eastern and southeastern Iowa will receive $36,553 through the U.S. Department of Justice Bulletproof Vest Partnership (BVP).  The BVP provides funding to state and local law enforcement jurisdictions for purchasing critical bullet-resistant body armor for law enforcement officers.

"It is vital that our law enforcement officers have the safety equipment they need to protect themselves as they protect all of us," said Loebsack.  "This live saving funding will allow our local law enforcement to purchase the state-of-the-art bulletproof vests our officers deserve."

Jurisdictions receiving the funding include : Albia, Bettendorf, Clinton, Coralville, Henry County, Iowa City, Keokuk, Knoxville, Lee County, Louisa County, Oskaloosa, Ottumwa, Pella, Scott County, Sigourney, and Van Buren County.
